LEGAL PROTECTION OF INDUSTRIAL DESIGNS

An industrial design is an art-and-engineering finding of the product of industrial or handicraft manufacturing which determines its appearance – design.

Legal protection is afforded to the industrial design if it is novel and original by its essential characteristics.

The essential characteristics of the industrial design include the characteristics defining aesthetic and (or) ergonomic features of the product appearance, in particular shape, configuration, decoration, and color combination (article 1352 of the Civil Code of the Russian Federation).

The protective document is Patent.

The duration of an industrial design on the RF territory is 15 years, provided payment of annual patent taxes. There is possibility to extend it for five years.
